1. Overview
At Semmon Engineers, we are committed to delivering reliable, system-driven software and hardware solutions to Indian MSMEs. This Refund Policy outlines the terms under which refunds may or may not be applicable across our range of products and services.
By purchasing any Semmon product or service, you agree to the terms of this Refund Policy.
2. SaaS Subscription Fees
Monthly Subscriptions:
All monthly subscription fees are non-refundable. If you cancel your subscription, access will continue until the end of the current billing cycle. No prorated refunds will be issued for unused days.
Annual Subscriptions:
Annual subscription fees are non-refundable once the subscription period has commenced. We strongly recommend evaluating our platform through a product walkthrough or trial period (where offered) before committing to an annual plan.
Upgrades / Downgrades:
If you upgrade your plan mid-cycle, the difference will be charged on a prorated basis. Downgrades take effect from the next billing cycle. No refunds are issued for the difference on downgrades.
3. Setup and Implementation Fees
Setup, onboarding, and implementation fees are strictly non-refundable. These fees cover time, resources, and technical work invested by the Semmon team prior to or during deployment — regardless of whether the client proceeds to active use of the platform.
4. Hardware Sales
Semmon-Branded Devices:
Hardware purchases are non-refundable once delivered and installed. Defects in Semmon-branded hardware reported within the warranty period will be addressed through repair or replacement at Semmon's discretion — not through a monetary refund.
Third-Party Devices:
Devices sourced from third-party manufacturers are subject to the respective manufacturer's return and warranty policy. Semmon Engineers will assist in coordinating warranty claims on a best-effort basis.
Damaged or Incorrect Shipments:
If you receive a damaged device or an incorrect product, you must notify us within 48 hours of delivery with photographic evidence. We will arrange a replacement at no additional cost.
5. Annual Maintenance Contract (AMC) Fees
AMC fees are non-refundable once the contract period has commenced. AMC coverage, inclusions, and exclusions are defined in the signed AMC agreement between Semmon Engineers and the client.
6. Exceptional Circumstances — When Refunds May Be Considered
Semmon Engineers may, at its sole discretion, consider refunds or credits in the following exceptional circumstances:
Duplicate / Double Payment:
If a technical error results in duplicate billing, the excess amount will be refunded within 7 working days.
Service Non-Delivery:
If Semmon Engineers is unable to deliver a contracted service due to reasons entirely on our side, a prorated refund for the undelivered period may be issued.
Pre-Activation Cancellation:
If a client cancels a new subscription within 24 hours of payment and before any onboarding or setup work has commenced, a full refund may be considered on a case-by-case basis.
Early Termination of Annual Subscription:
Clients who wish to terminate an annual subscription before its expiry may apply for a partial credit note (not a cash refund) for the remaining unused months, minus a 20% early termination fee. This credit note is valid for 12 months from the date of issuance and may be applied toward any future Semmon service or product. This is offered at Semmon's sole discretion and is not an entitlement. No cash refunds will be issued under this clause.
All requests under this clause must be submitted in writing to kiran@semmon.com within 7 days of the intended termination date.
7. Refund Process
Approved refunds will be processed as follows:
Refunds will be credited to the original payment method (bank account, UPI, or card).
Processing time: 7–10 working days from the date of approval.
GST components of any transaction are non-refundable as per Indian tax regulations once an invoice has been issued.
Credit notes issued under the Early Termination clause will be delivered via email and are non-transferable.
8. Cancellation Policy
By the Client:
You may cancel your subscription at any time through your admin dashboard or by writing to kiran@semmon.com with 30 days' notice. Cancellation does not entitle you to a refund for the remaining subscription period. Early termination of annual subscriptions is subject to Clause 6 above.
By Semmon Engineers:
In the event Semmon Engineers terminates your account due to a breach of our Terms of Service, no refund or credit note will be issued for any remaining subscription period.
9. Governing Law
This Refund Policy is governed by the laws of India. Any disputes arising from this policy shall be subject to the exclusive jurisdiction of the courts in Pune, Maharashtra.
